Terms of Use

1. Acceptance of Terms

By downloading, installing, or using POPs ("the App"), you agree to these Terms of Use. If you do not agree, do not use the App.

POPs is provided by Continuity Labs, Inc., a Delaware corporation.

2. Description of Service

POPs is a Life HQ application that consolidates your calendar, tasks, and contacts into one interface. The App provides:

• Voice, text, and photo capture
• AI-powered entity extraction (people, tasks, events, places, goals, aspirations, ideas)
• Unified today view with calendar and tasks
• Natural language queries
• Cross-device sync via iCloud
• Premium features including email metadata, Watch capture, widgets, and more

3. Free and Premium Tiers

POPs offers both free and premium tiers:

Free Tier includes:

• Voice and text capture
• AI entity extraction (7 types)
• Review flow
• Today view (calendar + tasks)
• Basic People view
• 5 queries per day
• 30 days of card history

Premium Tier includes everything in Free, plus:

• Unlimited queries
• Unlimited card history
• Email metadata intelligence
• Relationship alerts
• Apple Watch capture
• Home screen widgets
• Cross-app orchestration
• Pattern insights
• Photo/OCR capture
• Data export

4. Subscription Terms

Premium features are available through subscription:

Free Trial: New users receive a 7-day free trial of Premium features. No credit card is required to start the trial. You will receive a notification 2 days before the trial ends.

Billing: Subscriptions are billed through Apple's App Store. Payment will be charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.

Cancellation: You may cancel your subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial periods.

5. User Responsibilities

You agree to:

• Use POPs in compliance with all applicable laws
• Maintain the confidentiality of your iCloud account
• Not use the App for any unlawful purpose
• Not attempt to reverse engineer, modify, or distribute the App
• Not use the App in any way that could harm, disable, or impair our services

6. AI-Powered Features

POPs uses artificial intelligence (Claude by Anthropic) to extract entities from your captures. You acknowledge that:

• AI extraction may not be 100% accurate
• You are responsible for reviewing and confirming extracted entities
• AI processing requires an internet connection
• Your transcribed text is sent to our AI service for processing but is not stored

7. Third-Party Services

POPs integrates with the following third-party services:

• Apple iCloud: For data sync across your devices
• Apple Calendar & Contacts: For event and contact integration
• Google Gmail: For email metadata (Premium, optional)
• Anthropic (Claude AI): For entity extraction
• Google Cloud Platform: For AI proxy and analytics

Your use of these services is subject to their respective terms and privacy policies.

8. Intellectual Property

The App and its content (excluding your personal data) are owned by Continuity Labs, Inc. and protected by copyright, trademark, and other intellectual property laws.

You retain ownership of all content you create within the App (captures, entities, etc.). By using the App, you grant us a limited license to process your content solely to provide the App's functionality.

9. Privacy

Your use of POPs is governed by our Privacy Policy, incorporated by reference. Please review it carefully.

10. Disclaimers

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE ERROR-FREE, UNINTERRUPTED, OR FREE OF HARMFUL COMPONENTS.

POPs is designed to help you organize your life. The quality and accuracy of extracted entities depends on the clarity of your captures and the performance of AI systems.

POPs is not a replacement for professional calendar, task management, or contact management systems for critical applications.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CONTINUITY LABS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, MISSED APPOINTMENTS, OR FAILED COMMUNICATIONS.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless Continuity Labs, Inc. and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via the App or email. Continued use of the App after changes constitutes acceptance of the new Terms.

14. Termination

We may terminate or suspend your access to the App at any time for violation of these Terms or for any other reason at our discretion. Upon termination, your right to use the App ceases immediately.

You may stop using the App at any time. Your data remains in your iCloud account and is not affected by discontinuing use of the App.

15. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Delaware.
